Terms and Conditions for Elk River Motorcycle Training Academy

Welcome to Elk River Motorcycle Training Academy! By enrolling in or using our services, you agree to the following Terms and Conditions. Please read them carefully before proceeding with your registration or participation in any of our courses. These Terms govern the use of our training programs, services, and website.

1. General Information

Elk River Motorcycle Training Academy (referred to as "we," "our," or "the Academy") offers motorcycle training courses designed to provide riders with essential skills, knowledge, and safety techniques. By accessing our website or enrolling in our courses, you confirm that you are at least 18 years old or have legal parental consent to participate in our training.

2. Course Enrollment and Fees

a. Enrollment: Enrollment in courses is subject to availability and may require completion of an online or in-person registration form. 

b. Payment: Course fees must be paid in full prior to the start of the class. We accept payments via credit card, debit card, or other approved payment methods. 

c. Refunds, Cancellations, and Rescheduling:

  • All payments are final.  

  • Reschedules made at least 7 days before the course start date will be allowed to reschedule without penalty. Reschedules are subject to class availability.

  • Reschedules made less than 7 days before the course start date may be subject to a $75 rescheduling fee.

  • A maximum of three reschedules will be allowed within 1 year of the original class date.

  • All reschedules must be made by calling (931) 208-2055.

  • Elk River Motorcycle Training Academy reserves the right to cancel or reschedule a class at any time. In the event that the Academy cancels or reschedules a course, you will be offered a full refund or the opportunity to reschedule. Circumstances beyond our control could cause the class to be cancelled or rescheduled, including, but not limited to, inclement weather or a vehicle/obstacle on the range. We will make every effort to notify you of cancellations or changes as quickly as possible.

3. Eligibility

a. Physical and Mental Requirements: Participants must be physically fit and mentally capable of operating a motorcycle. If you have any medical conditions that may affect your ability to participate, please consult with a healthcare provider before enrolling. Participants must also have the ability to ride a bicycle.

b. Age Restrictions: Participants must be at least 14 ½ years of age by the class date. Anyone under the age of 18 must have a parent/guardian present on the first day of class to grant permission. Motorcycle licensing requirements are subject to local, state, and national regulations.

4.  eCourse Requirements 

​

 The MSF eCourse must be completed before class. The eCourse is approximately 4-5 hours long. You must bring your certificate of completion with you to class or be able to show it on your phone. The eCourse certificate is good for 60 days from completion.

5. Conduct and Safety

a. Safety Equipment: All participants must wear appropriate protective gear during all training sessions as specified by the Academy.  Any participant without the required clothing or gear will not be allowed to participate in class.  

  • DOT Approved helmet 

  • Protective eyewear (goggles, sunglasses, helmet visor, etc)

  • Long-sleeve shirt and/or jacket

  • Jeans, chaps or leather pants

  • Full-fingered gloves (cotton, leather, mesh, etc.)

  • Over-the ankle, sturdy footwear (no athletic or tennis shoes )

b. Behavioral Expectations: Participants are expected to follow all instructions provided by the instructors, adhere to safety rules, and demonstrate respectful behavior toward other participants, instructors, and staff. Failure to do so may result in dismissal from the course without refund.

c. Drug and Alcohol Use: The use of drugs or alcohol before or during training sessions is strictly prohibited. Any participant found under the influence will be immediately dismissed from the course without a refund.

6. Liability and Risk Acknowledgement

Motorcycle riding involves inherent risks, including the potential for injury or death. By enrolling in and participating in courses at the Academy, you acknowledge and accept the following: 

a. Assumption of Risk: You understand that motorcycle riding involves physical activities that carry inherent risks, including but not limited to falls, collisions, and other accidents. You assume all risks associated with your participation. 

b. Liability Waiver: You agree to release and hold harmless Elk River Motorcycle Training Academy, its instructors, independent contractors, employees, agents, affiliates, partners and/or sponsors from any liability, claims, or damages arising from your participation in any training or activities, to the fullest extent permitted by law.

7. Intellectual Property

All content provided by the Academy, including but not limited to instructional materials, videos, handouts, and logos, is protected by intellectual property laws. You agree not to copy, distribute, or use any of our materials for commercial purposes without prior written consent.

Elk River Motorcycle Training Academy will respect the intellectual property of others.  If you believe that your property has been used in any way that would be considered copyright infringement or a violation of your intellectual property rights, contact us in writing at the following address.

8. Privacy and Data Collection

We collect personal information during the enrollment process to facilitate course registration and communication with participants. This information will be handled in accordance with our Privacy Policy, which can be accessed on our website. Pictures will be taken during in person courses. These pictures may be posted on our website and/or social media accounts. Names will not be associated with any picture. If you wish to opt out of having your picture used, please let the instructor know or contact us at (931) 208-2055.

9. Changes to Terms and Conditions

Elk River Motorcycle Training Academy reserves the right to update or modify these Terms and Conditions at any time. Any changes will be posted on our website, and your continued participation in our courses will be subject to the updated Terms.

10. Governing Law

These Terms and Conditions are governed by the laws of Tennessee, United States, and any disputes related to these Terms shall be subject to the jurisdiction of the courts in Fayetteville, TN.
